General Terms and Conditions, as of 12.09.2025

Preliminary remark

ADAC Travel und Event Mittelrhein GmbH arranges ferry transportation services from providers (shipping companies) on its website. Hereby a contract between the customer and the provider (shipping company) comes into effect. Accordingly, the general terms and conditions of the providers apply to the respective booking.

The customer can find the general terms and conditions of the providers on the respective website of the provider. For this purpose, TE has created an overview, which can be found at www.adac-faehren.de/reeder-agb.

1. General

1.1 Scope of Application

These General Terms and Conditions apply to the arrangement of ferry transportation services (hereinafter referred to as service) between ADAC Travel & Event Mittelrhein GmbH (hereinafter referred to as TE), Viktoriastraße 15, 56058 Koblenz, represented by its managing director Georg Fuchs and the customer, via the website www.adac-faehren.de as well as other URLs (hereinafter referred to as "platform") in the version valid at the time of the conclusion of the contract.

For the arranged services as such, the corresponding General Terms and Conditions of the providers apply exclusively.

Should any conflicting General Terms and Conditions be used, they are hereby expressly rejected.

1.2 Contract agreement

The contract language is German.

"Users" are all persons who use the functions of the platform.

"Providers" are shipping companies/ferry transport service providers whose service offers are arranged via the platform.

"Customers", on the other hand, are users who enter into contractual relationships with the providers, i.e., the customers of the providers. A customer can only be a natural person who has reached the age of 18 or a legal person or partnership who has been represented at the time of registration by a person authorized to represent the company, which must be named.

"Agent" is ADAC Travel & Event Mittelrhein GmbH.

"Agencies" are travel agencies that also act as intermediaries.

2. Description of services

2.1 General

Customers can book the services of the providers via the platform. TE acts only as an intermediary and provides only the platform for the arrangement. If a service booking is made, TE itself does not become a contractual partner. The contract is concluded exclusively between the provider and the customer. The respective general terms and conditions of the providers apply.

The customer can find the general terms and conditions of the providers on the respective website of the provider. For this purpose, TE has created an overview, which can be found at www.adac-faehren.de/reeder-agb.

The advertising of the respective offers is carried out by TE. TE reserves the right to make any necessary adjustments to the content supplied by the provider to adapt it to the design used on the platform or to make the necessary formatting changes.

In principle, TE does not check whether the content transmitted by providers to TE and information provided by customers is lawful, truthful and complete. TE merely places them on the platform.

2.2 Service provision

TE is entitled to have the arrangement service performed by third parties.

2.3 Time of performance

Unless expressly agreed otherwise, TE shall provide the arrangement service immediately.

If the booking is made via the booking form or by telephone, TE shall generally provide the arrangement service within three days. The period for the arrangement service begins with the expiry of the day of the request. If the day on which the deadline ends falls on a Saturday, Sunday or a general public holiday recognized by the state at the place of performance, the deadline ends on the next working day.

3. Prices and Payment

The use of the platform as a customer is free of charge unless fees for specific services
apply in accordance with Section 5 of these Terms and Conditions.

When a contract is concluded between the provider and the customer, TE collects the customer’s payments on behalf of the provider. TE acts as an agent and in the name of the provider.
All prices are exclusive of any applicable booking or system fees as per Section 5 of these Terms and Conditions, which will be transparently communicated to the customer during the
booking process.

4 Conclusion of Contract between Provider and Customer

4.1 Via the platform

TE offers customers the opportunity to purchase services from providers through the platform. However, TE does not become a contractual party concerning the travel service but
merely provides the platform for both providers and customers.

The contract conclusion consists of four steps:

The presentation of the providers' various services on the platform of TE is initially subject to confirmation and non-binding.

 

In the first step, the customer selects the necessary details for their trip (outbound and/or return journey, departure and destination port, date).


In the second step, the customer receives an overview of the available services offered by the providers based on their selected details. The customer can then choose a service from a provider.


In the third step, the customer must provide additional details, particularly regarding the traveling persons, accommodation, vehicles, and additional services such as pets. By clicking the “Price Calculation” button, the customer receives a binding offer from the provider.


By clicking the “Proceed to Booking” button, the customer moves to the fourth step, where they enter their personal details, delivery address, and, if applicable, a different billing address, select a payment method, and accept these General Terms and Conditions as well as those of the provider.


By clicking the “Place Binding Order” button, the customer declares their binding acceptance of the contractual offer. Upon acceptance of the offer, the contract is concluded between the customer and the provider, incorporating the additional terms (e.g., the provider's general terms and conditions and cancellation policy) as well as between the customer and TE regarding any applicable fees according to Section 5 of these Terms and Conditions. The customer is then redirected to the payment page to complete the payment.


A separate storage of the contract text does not take place.


The ticket will be sent to the customer via email following the booking.

4.2 Price inquiry and booking using a form

Alternatively, the customer can send TE a non-binding price inquiry or a booking request directly using the form provided. In case of a booking request, the completed form represents the customer's binding contractual offer to the provider, which the provider can accept. Through acceptance, the contract between the customer and the provider is concluded. TE acts only as an intermediary. The content of the contract results from the agreement reached; separate storage of the contract's text does not take place.

4.3 Booking via an agency (travel agency)

Furthermore, the customer can make a booking at an agency (travel agency), which arranges ferry bookings through TE.

The agency shall hand over TE's agency terms and conditions to the customer prior to the booking. It shall draw the customer's attention to the fact that the shipping company's terms and conditions shall apply exclusively to the transport service.

By placing an order through the agent, the customer submits his binding contractual offer to the provider. TE is entitled to accept the contract offer contained in the order on behalf of the respective provider within two days after receipt of the order by e-mail, fax, telephone or mail. The contract between the customer and the provider is only concluded upon acceptance.

The ticket will be sent by e-mail following the booking.

4.4 Storage of the contract text

The text of the contract will be stored by TE and sent to the customer in text form (e.g., by e-mail, fax or post) after the order has been sent together with these General Terms and Conditions and customer information. However, the contract's text can no longer be retrieved by the customer via the website after sending the order.

Terms & Conditions

5. Fees

5.1 Service Fee for Rebooking and Cancellation

For rebooking or cancellations of booked services by the customer, TE charges a service fee
of €20.00. Additionally, providers may charge separate fees.

5.2 Booking Fee

For using the booking platform, TE charges a booking fee according to the following tiered
pricing (all prices include VAT):

This booking fee is displayed separately to the customer before the contract is concluded
and added to the total travel price.

5.3 Refundability of the Booking Fee and System Provision Fee

The booking fee covers the effort involved in individually processing your booking, including recording, reviewing, and storing your booking data as well as generating and delivering your booking confirmation. The system provision fee covers the technical costs for providing, maintaining, operating, and developing the booking platform, ensuring system availability, and securing data.

The fees mentioned in sections 5.2 and 5.3 are generally non-refundable, as the corresponding services are fully rendered upon completion of the booking process. This also applies in the event of a subsequent cancellation of the booked main service by the customer.

This does not affect the right to reimbursement of charges that must be passed on to third parties and are only incurred if the booked service is actually used (such as government fees, taxes, or other personal charges).

Any existing right of withdrawal remains unaffected by this provision.

6. Resale of tickets

Purchased tickets are bound to the name. A sale of the tickets to commercial dealers is prohibited. The commercial resale of tickets to third parties is also prohibited.

7 Usability of the services

7.1 Further development of the service / Availability

TE endeavors to adapt the arrangement services to current technical developments. TE, therefore, reserves the right to make changes to the agreed arrangement services, provided that such changes do not affect the core services and are reasonable for the User, taking into account the User's interests. We are also entitled to interrupt the platform operation wholly or partially within reasonable limits for updating and maintenance. In this respect, TE does not guarantee the availability of the offered arrangement services at any time and does not warrant that the provided arrangement services or parts thereof will be made available and can be used from any location.

7.2 Technical requirements

The use of the platform requires corresponding compatible devices. It is the customer's responsibility to put or keep the device in a condition that enables platform services.

8 Liability

8.1 Exclusion of liability

TE and its legal representatives and vicarious agents shall only be liable for intent or gross negligence. Insofar as essential arrangement contract obligations (consequently, such duties whose compliance is of particular importance for the achievement of the purpose of the contract) are concerned, liability shall also be assumed for slight negligence. In this case, liability shall be limited to the foreseeable damage typical for the contract. In relation to entrepreneurs, TE shall be liable in the event of a grossly negligent breach of non-essential arrangement contract obligations only to the extent of the foreseeable, contract-typical damage.

8.2 Reservation of liability

The above exclusion of liability does not apply to liability for damages resulting from injury to life, body or health. The provisions of the Product Liability Act shall also remain unaffected by this exclusion of liability.

8.3 Clarification of liability

The responsibility for a complete and timely provision of services lies exclusively with the provider.

9. Final provisions

9.1 Place of jurisdiction

The exclusive place of jurisdiction for all legal disputes arising from this contract shall be the registered office of TE, provided that you are a merchant, a legal entity under public law or a special fund under public law.

9.2 Choice of law

As far as there are no compelling legal regulations according to your home country law, German law under exclusion of the CISG is considered as agreed.

9.3 Consumer dispute resolution procedure

We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9.4 Severability clause

The invalidity of individual provisions shall not affect the validity of the remaining General Terms and Conditions.
